PAYMENT POLICIES

You, as a employer, shall pay the transaction price through your issuing bank to STANDARDMAIDS.COM using payment facility. you, as a employer, shall be entitled to claim a refund of the transaction price (as your sole and exclusive remedy) In case you do not raise a refund claim using website features within the stipulated time than this would make you ineligible for a refund. you, as a employer, understand that the payment facility may not be available in full or in part for certain category of services and/or transactions as mentioned in the policies and hence. Refund shall be made in Indian rupees only and shall be equivalent to the transaction price received in Indian rupees. refund shall be subject to employer complying with policies. STANDARDMAIDS.COM reserves the right to refuse to process transactions by employers with a prior history of STANDARDMAIDS.COM or breach/violation of any law or any charges imposed by issuing bank or breach of any policy.

You shall comply with all the applicable laws (including without limitation foreign exchange management act, 1999 and the rules made and notifications issued there under and the exchange control manual as may be issued by reserve bank of India from time to time, customs act, information and technology act, 2000 as amended by the information technology (amendment) act 2008, prevention of money laundering act, 2002 and the rules made there under, foreign contribution regulation act, 1976 and the rules made there under, income tax act, 1961 and the rules made there under, export import policy of government of India) applicable to them respectively for using payment facility and STANDARDMAIDS.COM website. all valid credit / debit/ cash card and other payment instruments are processed using a credit card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the employer and the respective issuing bank and payment instrument issuing Standard personal services India Pvt Ltd. All online bank transfers from valid bank accounts are processed using the gateway provided by the respective issuing bank which supports payment facility to provide these services to the users. All such online bank transfers on payment facility are also governed by the terms and conditions agreed to between employer and the respective issuing bank. Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Coimbatore.

GUIDELINES

1. Replacement policy:

1.1 : If employee leaves the job, The employer can release the candidate held online on recruit new candidate provided your login account credential plans.

1.2 : If the employer wants to forego the present candidate and recruit a new candidate no replacement fee will be charged till the limit exceeds their plan limit.

2. Sunday work:

Work on Sundays is voluntary and a domestic worker/ gardener/ cleaner can therefore not be forced to work on a Sunday.

If the employee works on a Sunday, he/she shall be paid the daily wage.

3. Public Holidays:

The days mentioned in the Public Holidays Act must be granted but the parties can agree to further public holidays. Work on a public holiday is entirely voluntary and a domestic worker may not be forced to work on such public holidays.

The official public holidays are:

Republic Day, Independence Day, Mahatma Gandhi's Birthday (2nd October), Diwali , Ganesh Chaturthi , Holi, Dussera, Eid , Good Friday, Muharram , Guru Nanak Jayanti, Christmas, Mahaver Jayanti. Any other day declared an official public holiday from time to time should also be granted. These days can be exchanged for any other day by agreement. If the employee works on a public holiday, he/she shall be paid double the normal days wage.

4. Deduction from the remuneration:

The Basic Conditions of Employment Act prohibits an employer from deducting any monies from the worker's wages without his/her written permission.

5. Prohibition of Employment:

The Basic Conditions of Employment Act prohibits employment of any person under the age of 15 and it is therefore important for an employer to verify the age of the domestic worker by requesting a copy of the identity document or birth certificate.

6. Refund Policy

6.1 If the employer has chosen the package and made the payment, And has not viewed full profile of any candidate a refund of 100% of the amount paid will be given back to the employer.

6.2 If the employer has chosen economy plan and selected a candidate and is not genuinely satisfied with the candidate, standardmaids.com will assist the employer to view another one more candidate.

6.3 In other package plans Silver, Gold, Platinum and Overseas if the employer is not satisfied with the candidate , he/she can select other candidates free of cost for the limit in the employer's package.

6.4 If the plan is to be upgraded, the employer can pay the difference amount and chose the higher package ( Provided that no selection of candidate is made in first package).

7. Other conditions of employment:

There is no provision, which prevents any other conditions of employment being included in a contract of employment but any provision which sets conditions which are less favourable than those set by the Act, would be invalid.

8. Disclaimer

8.1.While every effort is made by the Standard personal services India Pvt Ltd to ascertain and verify the qualifications, skills, experience etc. of the Candidate through trained data collectors, the Standard personal services India Pvt Ltd does not warranty the accuracy of the information gathered. You are required to interview the Candidate prior to employment to you.

8.2.The Standard personal services India Pvt Ltd and its affiliates and associates shall not be liable, at any time for any, direct, indirect, punitive, incidental, special, consequential, damages (including, without limitation, damages for loss of business projects, damage to your computer system or damages for loss of profits, damages for loss of use, data or profits),arising out of or in any way connected with the use or performance of the Website and, with the delay or inability to use the Website or its Services, the provision of or failure to provide services, or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on the site or for any information, software products, services and related graphics obtained through the Website, or otherwise arising out of the use of the Website arising in contract, tort or otherwise from the use of or inability to use the Site, or any of its contents or from any act or omissions a result of using the Site.

  • (b) Unauthorized access by third parties to data or private information of any User(s);
  • (c) Any matters relating to the Services however arising, including negligence.
  • (d) Any actions of the Candidate during the course of Employment with you.

10. Intellectual Property Rights

All the intellectual property rights relating to the Standard personal services India Pvt Ltd or Website including but not limited to the name, logo, trademark, design, layout, look, appearance, content and graphics and Database, shall solely and exclusively belong to the Standard personal services India Pvt Ltd. You shall not have any right or claim over the same.
